Terms of Service

The Service is an educational tool for simulated (paper) trading. It does not place real trades for members and does not provide investment, financial, legal or tax advice. For every recommended pick, the Service automatically places a simulated $5,000 practice trade in your own paper account using simulated money only (no real money, no real or broker orders); see the Disclaimer for how these work. They are information only, not financial advice, and not a recommendation that you make any real trade. Picks are generated by automated AI agents, are the same for every member, and may be wrong. See the Disclaimer.

You must be at least 18 years old and able to form a binding contract to use the Service.

You are responsible for keeping your sign-in details secure and for all activity under your account. Give accurate information and tell us promptly at sreyancapitalandinvestment@gmail.com if you suspect unauthorized use. One account per person.

You agree not to:

• break any law or use the Service to manipulate markets or mislead others;
• try to access other members’ data, admin features, or systems you are not allowed to use;
• scrape, overload, reverse engineer or disrupt the Service;
• resell, republish or redistribute picks or content without written permission;
• present SmartTrade picks or simulated results as personalized advice or real performance.

The Service, its data and its picks are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any result, profit or uptime.

To the fullest extent allowed by law, SmartTrade and its owner will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any trading losses, lost profits or lost data, arising from your use of the Service, even if advised of the possibility. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.

You agree to defend, indemnify and hold harmless SmartTrade and its owner from any claims, losses and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your decisions, or your breach of these Terms.

You may stop using the Service at any time. We may suspend or close your account at any time, with or without notice, for example if you break these Terms. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules.

[Arbitration and dispute-resolution terms to be added after attorney review.] Until then, any dispute will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.

We may update these Terms. When we do, we will change the “Last updated” date above and may ask you to accept the new version before continuing. Continued use after a change means you accept it.
